TERMS OF SERVICE

Once payment has been completed, you own the character/design. However, I retain the copyright to my original artwork.

♡ What you can do with your character

• Use the character in personal stories, roleplay, worldbuilding, etc.
• Use the character as a personal icon, profile picture, banner, or similar.
• Use the character in personal, non-commercial merchandise.
• Redesign or modify the character.
• Commission other artists to draw the character.
• Trade, gift, or resell the character according to this TOS.
• Use the character in NSFW/fetish contexts, subject to the boundaries below.

♡ What I retain

I retain the copyright and authorship of my original artwork. This means purchasing a design does not transfer ownership of the artwork itself.

I may display the original artwork in my portfolio, gallery, social media, or other promotional spaces.

I will use a watermarked version of the original artwork when showcasing a character after its sale.

When publicly posting the original artwork or introducing the character, please credit me as the original designer/artist. This is a preference rather than a requirement to include credit every single time.

You are welcome to modify your character in whatever way you see fit. Once you own the design, it is yours to develop and make your own.

• Change colors, markings, clothing, hairstyles, etc.
• Redesign the character.
• Create alternate outfits or forms.
• Create alternate species/forms, subject to the species rules below.
• Paint over or modify my artwork for personal use.
• Commission another artist to redesign or reinterpret the character.

♡ Closed Species

You may create alternate species or forms for your character, but please do not turn a purchased design into a closed species without asking me first.

Creating and commercially operating a closed species based on one of my designs is considered a commercial use and may require an additional license. See 03 — Commercial Use for details.

My designs are intended for personal use by default. Commercial rights are not automatically included unless the original listing specifically says otherwise.

Commercial use includes, but is not limited to:

• Using the character as a mascot or logo for a business.
• Selling merchandise featuring the character.
• Using the character to advertise or promote a business, product, or service.
• Making the character a major feature of a commercial game, comic, animation, or similar project.
• Otherwise using the character as a commercial asset.

♡ Commercial Licenses

If you would like to use a design commercially, please contact me before beginning commercial use.

As a general guideline:

• Commercial use: approximately +50% or more of the original design price.
• Closed species: approximately +100% or more of the original design price.

These prices are only guidelines. The final licensing fee may vary depending on how the design will be used, the size of the project, and how prominently the character is featured.

Commercial permission applies to the current owner and does not automatically transfer to another owner unless explicitly agreed upon.

You may resell, trade, or gift a design that you own, provided that the rules below are followed.

♡ Reselling

A design may not be resold for more than its original purchase value unless additional value has been added.

Additional value may include:

• Your own artwork.
• Commissioned artwork or media.
• Significant redesign or design work.

Please keep track of the value of additional work if you intend to resell the character.

Free designs may not be resold for currency. They may instead be gifted or traded.

Please do not artificially inflate a character's value simply to justify a higher resale price.

♡ Trades & gifts

Trade values should generally correspond to the original purchase or trade value of the design.

I may ask for proof of the original purchase or trade if there is a dispute regarding a character's value.

Gifting a design is allowed. The recipient becomes the new owner and is subject to this TOS.

♡ Emergency resales

If you need to resell a design quickly due to an emergency or unexpected circumstance, please contact me, I am willing to make exceptions.

My artwork remains copyrighted to me. Purchasing a character does not grant ownership of the artwork used to depict them.

Please do not:

• Claim my artwork as your own.
• Trace my artwork.
• Copy my artwork and present the copy as original work.
• Remove my watermark or signature for redistribution.
• Sell or redistribute my artwork by itself.
• Use my artwork to create another adoptable.
• Use my artwork commercially without permission.

You may make reasonable personal edits to artwork of your character, but please keep the original artwork and do not present a heavily edited version as my original work.

♡ Adoptables

• Payment must be completed within 48 hours of claiming/purchasing unless another arrangement has been discussed beforehand or stated on the listing itself.
• If you need more time, contact me before the deadline.
• Please do not claim a design if you do not intend to pay for it.
• Sales are final once the design has been transfered.

♡ Customs

• Payment terms will be stated when the commission is accepted.
• I may require payment before beginning the design.
• If you cannot make a payment on time, please contact me as soon as possible.

♡ Chargebacks

Custom designs are subject to the same ownership, commercial use, artwork, and AI rules as my other designs.

I reserve the right to decline a custom request if the subject is outside my comfort zone, conflicts with this TOS, or would require work that I do not believe I can reasonably provide.

♡ Things I currently don't draw

• NSFW
• Paid closed species
• Character-based designs / designs directly based on existing copyrighted characters
• Mecha

This is not necessarily an exhaustive list. I may decline a request for another reason if I don't feel that I am the right artist for it.

♡ NSFW & fetish content

I do not prohibit owners from using their characters in NSFW or fetish contexts, provided the content itself is lawful and does not violate the boundaries below.

However, I do not condone, support, or permit my designs to be affiliated with content that romanticizes, sexualizes, or positively promotes "proship"-adjacent interests.

This includes, but is not limited to, sexualized minors, incestuous relationships, or other similar content that I consider exploitative or inappropriate.

You are solely responsible for how you use your character after purchasing it, and I will not "revoke" a design from you if I find it is used in this manner. However, I reserve the right to refuse future sales or commissions (blacklist) if a design is knowingly used in ways that violate these boundaries.

♡ General conduct

• Do not use my designs or artwork to promote hate speech, harassment, or discrimination.
• Do not impersonate me, steal, or misrepresent my work maliciously.
• Do not attempt to circumvent purchase or payment rules.
• Please do not repeatedly pressure me for progress updates (multiple times a day/within a short period of time).

You are welcome to ask for updates, but repeatedly requesting them will not make the process faster. Please allow me reasonable time to work, I will inform you of any setbacks or issues that may occur!

These terms apply regardless of how a design was obtained. This includes designs that were:

• Purchased directly from me.
• Purchased from a previous owner.
• Obtained through a trade.
• Received as a gift.

These terms may be updated in the future. Updates will not retroactively remove permissions from previously purchased designs unless otherwise agreed upon.
